Visiting our website (www.myaip.ai) (hereinafter, also the “Site”) involves the processing of data related to identified or identifiable natural persons. In compliance with the obligations under Regulation (EU) No. 2016/679 (hereinafter, also the “Regulation” or “GDPR”), this information describes, with maximum transparency, the methods by which personal data of visitors and/or users who access the aforementioned Site are processed. The information provided below refers exclusively to the aforementioned Site. It does not apply to channels other than the Site and, in particular, does not concern other websites, pages, and/or services accessible via hypertext links published on this Site. FIVEN S.p.A. is not responsible for violations and/or damages caused by activities on other websites, pages, and/or services accessible via hypertext links published on this Site.

Data controller

The data controller is FIVEN S.p.A. (Tax Code and VAT No. 05794871219), with registered office at 80127 – Naples (Na), Via Belvedere 101 (hereinafter also referred to as the “Data Controller”), contactable by email at info@fiven.eu and by certified email at fiven@pec.it. Legal basis for processing FIVEN S.p.A. processes personal data based on one of the following legal grounds, depending on the purpose of the processing: consent from the data subject; necessity for the pursuit of a legitimate interest of the Data Controller.

Data collected and the purpose of processing

The IT systems and software procedures used to operate this Site acquire, in the course of theirnormal operation, some personal data whose collection occurs automatically through Internet communication protocols. These data are necessary to use Internet services. Among these, weinclude: – Internet Protocol (IP) address; – type of browser and device parameters used to connectto the site; – name of the Internet service provider (ISP); – date and time of visit; – referring and exiting webpage; – possibly, the number of clicks. These data are not processed to be associatedwith identified data subjects but, due to their nature, could, through processing with data held by third parties, allow the identification of users and/or visitors. These data are processed in an automated manner and collected in an aggregated form, for the pursuit of legitimate interests of the Data Controller and, specifically, to verify the correct functioning of the Site and ensurecybersecurity and network security, as well as the security of users and/or visitors; b. prevent the misuse of services and/or harmful and/or criminal activities; c. extract statistical information aboutthe use of the Site. Navigation data collected by the Site during its operation are used exclusivelyfor the purposes mentioned above and stored for the time strictly necessary to carry out the activities specified, and in any case for a period not exceeding 7 days. In any case, the data collected by the Site will never be provided to third parties, for any reason, unless it is a legitimaterequest from the judicial authority and in the cases provided by law.

Data provided by users and/or visitors

The communication of personal data, including contact data, by users and/or visitors, by sendingoptional and voluntary messages to the Data Controller's contact addresses and/or by filling out and submitting optional and voluntary forms on the Site and/or on sites linked to this privacy notice, implies the acquisition of such data and the consent to their processing. Users and/or visitors maydeny consent and/or revoke any previously given consent at any time, by completing and submitting the form on the Site. However, denying and/or revoking consent may result in FIVEN S.p.A. being unable to provide some services and/or perform certain services; moreover, the browsing experience on the Site may be compromised. If consent is revoked, the lawfulness of the processing based on consent before the revocation will not be affected. The data and information that users and/or visitors of the Site choose to provide through the services and tools made availableto them are provided voluntarily and knowingly, exempting FIVEN S.p.A. from any responsibilityfor potential violations of the law. Such data will not be communicated to third parties for any reason, unless it is a legitimate request from the judicial authority and in the cases providedby law.

Cookies

As is common with all websites, this Site also uses cookies. Technical cookies

Place of processing

Personal data collected by the Website are processed at the data controller’s premises, located at80127 – Naples (Na), Via Belvedere 101, and at the data center of the web hosting service provider Aruba S.p.A. (VAT No. 01573850516), located at 52011 – Bibbiena (AR), Località Palazzetto No. 4. Aruba S.p.A., processing personal data on behalf of the data controller, has been appointed as the data processor. The aforementioned data processor is located within the European Economic Area and acts in compliance with European regulations.

Transfer of data to countries outside the EU

To pursue the purposes of processing described in this privacy notice, some of the personal data processed may be transferred to countries outside the European Economic Area (“EEA”). FIVEN S.p.a. guarantees that any transfers outside the EEA will be carried out in a way that ensures the full protection of users' and/or visitors' rights and freedoms. If no adequacy decisions have been issued by the European Commission under Article 45 of the Regulation with regard to the third-country recipient, FIVEN S.p.a. will transfer the collected personal data only if the recipient has provided adequate guarantees pursuant to Article 46 of the Regulation or has ensured the application of standard contractual clauses approved by the European Commission under Decision No. 2010/87/EU..

Security measures

The data controller processes users' and/or visitors' personal data lawfully and fairly, ensuring full compliance with the Regulation. The data controller ensures a level of security proportional to the risk and implements appropriate security measures to protect the confidentiality of users and/or visitors, making every possible effort to prevent unauthorized access, disclosure, alteration, or destruction of personal data. Processing is carried out using computer and/or telematic tools, with organizational methods and logic strictly related to the purposes outlined.

Recipients of personal data

In addition to the data controller, personal data of users and/or visitors to the Website may be accessed by authorized persons trained and instructed to process data under the direct authority of the data controller (such as administrative, commercial, and/or marketing personnel, internal legalstaff, system administrators) or third parties appointed as external data processors pursuant to Article 28 of the Regulation, under a specific contract.
